1) Since September 11, 2001, our country has become acutely alert to the risks and threats impacting our nation's homelands by an ever expanding array of invasive enemies in our midst, including a 5th Column of domestic eco-terrorists. The term 5th Column was first applied in 1936 to clandestine subversive, rebel sympathizers organized within Spain to further the invading enemy's military and political aims inside Madrid when four columns of rebel troops were attacking that city. The California Watershed Posse (CWP) has established the 5th Column Vs US to rally public involvement and support for the Wise Use Movement cause of protection of their basic civil right to property while exposing the 5th Columns "The Wildlands Project". CWP supports the implementation of the Bay Area Public Opinion Survey findings for the San Francisco Watershed Management Plan (view State Auditor letter), the 9/11 ALERT S.F. Peninsula Watershed Security Plan, the Council for Environmental Quality Initiatives, the CWP Water Quality Protection Program, the California Fire Plan, the Healthy Forest Initiative, and the National Invasive Species (IS) Council Management Plan while seeking Environmental Justice for all Californians.

2) "Today the tyranny that our Founding Fathers feared threatens the American Dream and the Constitutional liberties that assure the future of the dream. Jefferson feared the tyranny of those who fear and distrust the people, and wish to draw all from them into the hands of the higher classes". Madison feared the tyranny of the majority and the abridgment of the freedom of the people by gradual and silent encroachments of those in power ." "John Adams feared all men, recognizing that the only maxim of the free government ought to be to trust no man living with power to endanger the public liberty". President George W. Bush proclaimed in his inaugural address: “The enemies of liberty and our country should make no mistake, Americans remain engaged in the world, by history and by choice, shaping a balance of power that favors freedom. We will defend our allies and our interests. We will show purpose without arrogance. We will meet aggression and bad faith with resolve and strength. And to all nations, we will speak for values that gave our nation birth.”

3) California is ranked the world's fifth largest economy, a well known fact. The State of California also has the dubious reputation of being corrupt. Most rural lands Americans know that this State is the world leader when it comes to racketeer influenced corrupt organizations (RICO). The Golden State is, a …cartel! California racketeer influenced corrupt organization CARICO began its ascendancy in 1978 in response to the overwhelming approval of Proposition 13. The impact of this taxpayer led rebellion on California's body politic was devastating. How would ``government" survive in a world where the indigenous people refused to be over taxed?! The defeated 5th Column embarked on a search for a new vision that would embolden them politically and financially. This new vision for governing California needed to be the perfect scheme with a proven marketing strategy; needed to provide ever growing revenue streams (no longer called taxes in CA); needed no political accountability, and most importantly provided maximum job security for government employees and elected officials while providing protection from virtually all judicial review. 4) A new "Wise Use" dogma is emerging in the United States that summons all rural community stakeholders to become involved in the coordinated resource management planning (CRMP) process in their homeland counties. The CRMP process embodies the proposition that the best way for rural communities to determine how to manage the interest in the natural environment is through collaboration among rural stakeholders, not through the usual governmental bureaucratic processes. The President's Council on Sustainable Development (PCSD) has strongly endorsed the community CRMP process. The PCSD sees the CRMP process as an extension of its empowerment programs for reinventing government, for decentralization, and place based resource management. Why Watersheds? 5) The CWP considers that protected private property rights are the fundamental civil rights upon which individual liberty rests. The Supreme Court of the United States strengthens the CWP view. The Court held in the landmark case of Lynch vs. Household Finance Corporation, decided March 23, 1972: The dichotomy between personal liberties and property rights is a false one. Property does not have rights. People have rights. The right to enjoy property without unlawful deprivation, no less than the right to speak or the right to travel, is in truth, a personal right, whether the property in question be a welfare check, a home, or a savings account. In fact, a fundamental interdependence exists between the personal right to liberty and the personal right to property. That rights in property are basic civil rights has long been recognized.( 405 U.S.538, 92 S. Ct. 1113 )

6) If that is true, government ownership of vast rural areas of our nation becomes clearly a key point of conflict as was insightfully reported in June 1998 to Congress by the Center for the Defense of Free Enterprise . The report was titled Battered Communities and was the lead testimony presented to the House Committee on Resources as part of the Center's efforts to preserve the rural resources communities of America. The Battered Communities (large pdf file, please be patient) testimony made the case that supposedly charitable environmental organizations with tax subsidieswere exercising undue influence over the lives of rural Americans with public policy measures which cut off access to vital natural resources that give all of us food, clothing and shelter. It is thus no surprise that the elimination of private property ownership in rural America has become a primary goal of these invasive 5th Column enemies of civil rights and free enterprise . Placing increasing amounts of private land in government ownership (permanent open space preserves) has become the key tactic in this conflict, whether by government condemnation (eminent domain) or purchased by environmental 5th Column groups such as The Nature Conservancy (TNC) and California Bay Area based Peninsula Open Space Trust (POST) that sells substantial amounts of the land that they buy from individuals to the government (special open space districts). What will become of ``your" personal right to liberty if government becomes the nation's dominant landowner?

7) That raises yet another question: How much of your county rural land does government already own? The aggressive efforts of local urban land trusts and open-space acquisition agencies have helped bring the current total of permanently removed private sector lands to about 1 million acres – almost 25 percent of the Bay Areas total acreage. And that amount is growing rapidly as literally tens of thousands of healthy private real estate tax paying acres of California are being removed from the private sector by ubiquitous invasive species governmental (MROSD, CCC & GGNRA) land grabbing agencies that are blighting the entire San Francisco Bay Area coastal and rural communities watershed areas while creating a working class housing crisis for the urban & suburban Bay Area. Who are these John Muir inspired "Envirocults" that impose their undue influence for oppressive "apartheid" cartel vision on all California working class families? The Sierra Club, MROSD, CCC, GGNRA, California Coastal Records Project, Restore Hetch Hetchy, Greenbelt Alliance aka, Natural Resource Defense Council, Committee for Green Foothills(CGF), Peninsula Open Space Trust (POST) and the William & Lucile Packard & Gordon & Betty Moore(Intel) Foundations to name but a few. 8) What is the Bay Area water users ``Watershed Vision" of the Hetch Hetchy regional water system? Read the only Public Opinion Survey (large pdf doc, please be patient) ever published of Households served by the San Francisco Water Department (SFWD). The Survey was conducted in February, 1994 by the San Francisco Water Department, Public Research Institute, San Francisco Sate University, in cooperation with EDAW, Inc. and Public Affairs Management. ``A survey was carried out in order to ascertain public opinion on issues of water quality, goals of watershed management, recreation, recreational access to the watersheds, environmental protection, financing, and other issues related to watershed management. Survey questions were based on SFWD goals for watershed management and on issues and input received from the public and from agencies at all levels of government . The findings of the survey will allow SFWD to take the opinions of its public constituency into account in the planning process." Compare the public opinion with the Bay Area ``Da Envirocult Vision".

9) The CWP No 5th Column 4 US will monitor the activities of county government and all 5th Column Envirocult organization collaborators cells operating within California's 58 counties that conspire and endeavor to restrict or deny us of our basic constitutionalcivil rights by lobbying their apartheid agenda. On October 7, 2002 the CWP filed their first legal action against the County of San Mateo Board of Supervisors and Doe 1 to Doe 100 for unconstitutional acts and unlawful denial of the California Watershed Posse, it's Directors families and farm laborer Bernie Neves of their basic civil rights to shelter, property and water rights. Furthermore, the CWP gave the Board of Supervisors their Notice of Intent (NOI) to file a Racketeer Influenced and Corrupt Organization Act ( RICO) referral to the U.S. Department of Justice regarding San Mateo County based corrupt Envirocult organizations and local government bureaucrats engaged in a pattern of unlawful racketeer influenced activity, through the commission of at least two acts of unlawful racketeering activity in the last ten years as set forth by the federal RICO statutes. 10) The California Watershed Posse is asking the House Resources Committee to hold investigative hearings on 5th Column Envirocult's undue influence RICO activities with activist government employees of the California Coastal Commission, California Resource Agency, California Regional Water Quality Control Board, California EPA, California Department of Fish & Game Commission, City and County of San Francisco, San Mateo County, and the Peninsula Open Space Trust, Mid-peninsula Regional Open Space Trust and GGNRA.

11) California's economic sustainability faces catastrophic risks from being destroyed from within by our Grey Governor and the unconstitutional California Coastal Commi-Czars with their ``PAY To PLAY" coastal rural land use extortion, bribery, fundraising and eco-terrorist racketeering activities. "The arbitrary way the California Coastal Commission exercises its combination of legislative, executive, and judicial functions and powers serves as the poster boy for abuse of government power," said Pacific Legal Foundation Attorney James Burling. Since 9/11, the California body politic and the state natural resource management institutionshave been revealed as unstable, incompetent, corrupt and now unconstitutional. It is time for U.S. Department of Justice intervention and Federal judicial RICO cleansing to begin. It is time to expose these apartheid enemies in our midst and stop them from destroying California's economic vitality and sustainability. It is time for California's ship of State to change course in the direction of Environmental Justice for all of it's people. The California Watershed Posse is requesting that the U.S. Attorney General impanel a Federal Grand Jury for the purpose of investigating the California Coastal Commission RICO activities.

12) The CWP believes an Environmental Justice land use policy that would best enhance individual liberty is one that reverses today's trend toward nationalization and divest government land ownerships into individual hands, free of easements and other burdens on title. Land ownership is not the only property right. Violated basic civil rights currently include: Water, Grazing, Mining, Timber and Privacy Rights .

Rural Incorporated Districts (RID)
13)The 2003 California Watershed Posse Living Legacy Program celebrated Martin Luther King’s birthday by launching their “helpRID.US” initiatives for the formation of Rural Incorporated Districts (RID) throughout all rural areas of California . The California Watershed Posse’s first RID will be formed in the unincorporated Rural Lands area of San Mateo County . The RID formation election will be held within the boundaries of the proposed RID in calendar year 2003. The incorporation charter for the RID will embody coordinated resource management and planning of vital Rural Lands area resource infrastructure such as water, sewer, roads, watershed natural systems, parks , and open space. The RID’s land use governing document will be a “RID General Plan” The primary goal of the RID is to secure “local control” of the RID areas in perpetuity while preserving , protecting, and providing sustainability of the quality of life values found in the Rural Lands area of California. 14) Alan Beaven was the California Watershed Posse co-founder and Clean Water Act legal counsel. Alan's passion was the protection of California's water quality and the watershed's natural systems. He made the ultimate sacrafice for this, his adopted country, on September 11, 2001 on United Airlines Flight 93. Alan Beaven was one of those heroes that died on 9/11 by fearlessly confonting the evil of terrorism. Alan's love of life, family and community compelled him to do what he had always done…the right thing.
