Eco Justice & The Meaning of “IS”

Before the California Watershed Posse's (CWP} No 5^th Column 4.Us Task Force can deploy their Rural indigenous forces counter-offensive campaign to "control" the enemies in our midst, these enemies must first be identified (Who.. is?)  That of course depends on what your definition of “is” is….as our former impeached President Clinton testified smugly to our nation while perjuring himself before our Federal Judiciary.  Who “is” the enemies in our midst? The 5^th Column in America today have successfully infiltrated the halls and chambers  of the “elites ruling class”   at all levels of government.  Their unchanged John Muir extremist agenda is to retain their urban seats of  power  while controlling California’s water and natural resources found in our Rural Lands. What about Environmental Justice? What about the sustainability and economic vitality  of  rural California?  California will not return to being the "Golden State" until we clean up the "pay to play" government corruption that was  Grey Davis administration's political  legacy. The California Watershed Posse (CWP) will provide the leadership to restore  Environmental Justice to rural California residents  by pursuing Constitutional judicial relief in Federal Court.  We, the CWP, have mounted up and are moving out in united  support  of Governor Arnold Schwarzenegger's visionary quest to protect California's future  while preserving our State's  rural communities quality of life and natural resources.

Alan Beaven was the California Watershed Posse co-founder and Clean Water Act legal counsel. Alan's  passion was the protection of California's water quality and the watershed's natural systems. He made the ultimate sacrafice for this, his adopted country, on September 11, 2001 on United Airlines Flight 93. Alan Beaven was one of those heroes that died on 9/11 by  fearlessly confonting the evil of terrorism.  Alan's love of life, family and community compelled him to do what he had always done…the right thing. The CWP will strive to preserve Alan Beaven's living legacy by protecting California's water quality and rural watershed areas. The CWP will provide the leadership, stewardship services and wildland urban interface (WUI) area security by deploying wireless early detection fire/water/intruder alert sentinel systems.

 A new dogma is emerging in the United States that summons all rural community stakeholders  to become involved in the coordinated resource management planning (CRMP) process in their homeland counties. The CRMP process embodies the proposition that the best way for the communities to determine how to manage the interest in the natural environment is through collaboration among rural stakeholders, not through the usual governmental bureaucratic processes.  .  The President's Council on Sustainable Development (PCSD) has strongly endorsed the community CRMP process. The PCSD sees the CRMP process as an extension of its empowerment programs for reinventing government, for decentralization, and place based resource management. It's your homeland. The Official Meaning of  “is”…  Since we are still a free republic that is governed by constitutional law and not man, the CWP has turned to the official definitions provided by the U.S. Department of Justice and  by President Clinton’s Executive Order 13112: Invasive Species (IS) Section 1. Definitions.

(a) "Alien species" means, with respect to a particular ecosystem, any species, including its seeds, eggs, spores, or other biological material capable of propagating that species, that is not native to that ecosystem.

(b) "Control" means, as appropriate, eradicating, suppressing, reducing, or managing invasive species populations, preventing spread of invasive species from areas where they are present, and taking steps such as restoration of native species and habitats to reduce the effects of invasive species and to prevent further invasions.

(c) "Ecosystem" means the complex of a community of organisms and its environment.

(d) "Federal agency" means an executive department or agency, but does not include independent establishments as defined by 5 U.S.C. 104.

(e) "Introduction" means the intentional or unintentional escape, release, dissemination, or placement of a species into an ecosystem as a result of human activity.

(f) "Invasive species" means an alien species whose introduction does or is likely to cause economic or environmental harm or harm to human health.

(g) "Native species" means, with respect to a particular ecosystem, a species that, other than as a result of an introduction, historically occurred or currently occurs in that ecosystem.

(h) "Species" means a group of organisms all of which have a high degree of physical and genetic similarity, generally interbreed only among themselves, and show persistent differences from members of allied groups of organisms.

(i) "Stakeholders" means, but is not limited to, State, tribal, and local government agencies, academic institutions, the scientific community, nongovernmental entities including environmental, agricultural, and conservation organizations, trade groups, commercial interests, and private landowners.

(j) "United States" means the 50 States, the District of Columbia, Puerto Rico, Guam, and all possessions, territories, and the territorial sea of the United States.

(k) “Eco-terrorism” is a crime committed to save nature. The crime must have the characteristics of terrorism as defined by the FBI:  Terrorism is the unlawful use of force or violence against persons or property to intimidate or coerce a government. civilian population,  or any segment thereof, in the furtherance of political or social objectives.  (citation FBI Terrorist Research and Analytical Center. Terrorism in the Untied States: 1994. Washington D.C. U.S> Department of Justice, 1995, page 24)

(l) “Domestic Terrorism” for comparison , in the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT ACT) Act of 2001, the term “Domestic Terrorism” means activities that : a) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State; (b) appear to be intended…(i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or kidnapping; and (C) occur primarily within the territorial jurisdiction of the United States.

(m) “Undue” More than necessary; not proper; illegal.

(n) “Influence” Power exerted over others.

(o) “Undue Influence” Persuasion, pressure, or influence short of actual force, but stronger than mere advice, that so overpowers the dominated party’s free will or judgment that he or she cannot ct intelligently and voluntarily, but acts, instead, subject to the will or purposes of the dominating party. Also, misuse of position of confidence or taking advantage of a persons weak, infirmity, or distress to change improperly that person’s actions or decisions.  ….Black’s Law Dictionary, Sixth Edition

(p) “RICO” stands for Racketeer Influenced and Corrupt Organization Act and was passed by Congress with the declared purpose of seeking to eradicate organized crime in the United States. (Russello v. United States) 5^th Column domestic terrorist organizations can and should be vigorously prosecuted under RICO for violations of such federal statutes as the Civil Rights Act and  Clean Water Act . Recently The National Organization of Women file a lawsuit against abortion clinic protesters under the RICO act and is currently before the U.S. Supreme Court.   The CWP believes that any convicted non-profit tax exempt organizations (501©3) or governmental Special Districts (Open Space & Resource Conservation Districts) should be striped of their special Federal and State tax exempt status, eminent domain powers and taxing powers for criminal activities covered under RICO

As morning broke across the sea,

The sunlight gleamed so tenderly

Alan will always stand at our sides.

And now he looks down from above.

My father I will surely miss,

But to feel sea breeze is to feel his kiss.

From rolling oceans you can hear,
